Newburgh Chicken returns to town planning board

After review and discussion, the Town of Newburgh Planning Board on March 7 voted for Planning Board Attorney Dominic Cordisco to prepare a referral letter to the town’s Zoning Board of Appeals. The reason for this referral is to appeal for amended site variances as a result of revised plans.

The Newburgh Chicken project proposes a new Popeyes Chicken restaurant at the Dairy Queen site, which is still closed, at the intersection of Route 52 and Route 300. The Dairy Queen has been proposed to be torn down. The site has been recognized as a nonconforming use for over 50 years under the town code.

Nonconforming uses refer to properties that are at times exempted from new zoning regulations. The project consists of a new 2,537 square foot fast food restaurant, 23 parking spaces and stacking lanes for potential customers.
