Newburgh Police investigate fatal altercation on Broadway

A man is dead and another injured following an altercation at an AutoZone store on Broadway in Newburgh, police said Monday.

On January 6, City of Newburgh Police received a call for a stabbing in the area of 515 Broadway. Arriving officers located two males suffering from injuries sustained during an altercation with each other at AutoZone Auto Parts, 536 Broadway: Carlos Colon, a 40-year-old Town of Newburgh resident, sustained a gunshot wound; and Xavier Webb, a 25-year-old City of Newburgh resident, sustained a stab wound. Officers on scene gave immediate medical care and both males were transported to Montefiore St. Luke’s. Cornwall Hospital.

Webb is being treated for what appears to be non-life-threatening injuries. Colon suffered fatal injuries from the altercation. 

The City of Newburgh Detective Division, along with Investigators from the Orange County District Attorney’s Office, investigated the incident. The surveillance video depicts an individual identified as Webb being approached and stabbed by another individual. Webb thereafter produced a pistol and fired a single round at the other person; that other person was later pronounced deceased from a gun shot wound. Webb thereafter concealed the pistol used in the altercation.   

Webb was arraigned on January 6, 2025, was held, and grand jury has been scheduled for Friday January 10, 2025. Webb is being charged with Criminal Possession of a Weapon 2nd Degree, a class C felony, and Tampering with Physical Evidence, a class E felony.
