Update to pistol-whipping assault during school dismissal (off-campus) on October 25

Two teenagers - ne juvenile and one adult - have been arrested and charged in the aftermath of a pistol-whipping assault that occured during dismissal on Oct. 25, City of Newburgh police have reported.

This incident gained wide-spread attention after it went viral on several social media platforms and showed a juvenile victim being struck with what appeared to be a black handgun. The juvenile perpetrator identified in this incident has turned himself in to the City of Newburgh Police and was charged with one count of Assault in 3rd Degree (Misdemeanor) and one count of Assault (with a Dangerous Instrument) in the 2nd Degree (Felony). The juveniles name will not be released. The adult perpetrator (Isaac Gonzalez-Smith, 19 years old) identified in this incident has also turned himself in and was charged with one count of Assault 3rd PL 120.00 sub 1  (Misdemeanor).

He was released with an appearance ticket and is due back in Newburgh City Court on 12/20/2021. An imitation pistol (BB Gun) with a metal frame was recovered during the investigation
