TOWN OF SHAWANGUNK
RESOLUTION SUBJECT TO PERMISSIVE REFERENDUM
At a regular, duly noticed meeting of the Town Board of the Town of Shawangunk held at the Town Hall Central Ave., Wallkill, NY 12589 on June 17, 2022, where a quorum of said Board was present, the following Resolution was moved by Councilman MILLER, seconded by Councilman DEWITT and upon a vote of 5 ayes (Supervisor JOHN VALK JR. and Councilmen MILLER, DEWITT, AMTHOR and DANON) and 0 nayes (0 absent) was declared duly adopted.
WHEREAS, the Wallkill Fire District has relocated its firehouse to NYS Rt. 208 and is no longer in need of its former facility at Central Ave. in the Hamlet of Wallkill; and
WHEREAS, the former facility is contiguous with the existing Town Hall property; and
WHEREAS, the Fire District has offered to sell the facility to the Town of Shawangunk for the sum of Three Hundred Fifty Thousand ($350,000) Dollars; and
WHEREAS, the electors of the Fire District have approved of this proposed sale by the District to the Town at an election held on December 14, 2021; and
WHEREAS, the Town Board finds it to be in the public interest to acquire the former firehouse property and renovate it to become the "Town Hall Annex"; and
WHEREAS, the Town Board has determined that it will purchase the facility with funds from its cash reserves and that there will not be any need for financing for the acquisition; and
WHEREAS, the mere change of ownership is not an "Action" per the SEQRA and the regulations thereunder; and
WHEREAS, as part of the transaction, the Town will enter into a lease with the Fire District to enable the existing siren to remain in its present location; the siren, compressor and other appurtenances to be owned, maintained and insured by the Fire District at an annual rent of Five Hundred ($500) Dollars for the initial term.
NOW, THEREFORE, BE IT RESOLVED that pursuant to Town Law Section 220(2) the Town of Shawangunk authorizes its Supervisor to appropriate the requisite funds to purchase the firehouse and to sign all necessary documents to effect the purchase and be it further
RESOLVED that this Resolution is subject to a Permissive Referendum per Town Law Article 7; qualified electors of the Town may petition the Town of Shawangunk within thirty (30) days to force this proposal to a mandatory referendum per Sections 90 and 91 of the Town Law and be it further
RESOLVED that a copy of this Resolution be posted and published promptly.
