ZONING BOARD OF APPEALS

PLEASE TAKE NOTICE, that the Zoning Board of Appeals of the Village of Montgomery will hold a Public Hearing on Monday, September 27, 2021, at 7:30 P.M. or as soon thereafter as can be heard at the Village Hall, 133 Clinton Street, Montgomery, NY 12549 to consider the application of Rowley Development Corp, on referral from the Planning Board, for an area variance from Sections 12210 of the Zoning Code to permit site plan approval and a special exception use permit to construct a two-story, mixed use building consisting of first floor commercial uses with 4 apartments on the second floor with a maximum building height of 38 1/2 feet instead of the required 35 feet.

The property is located at the corner of Charles Street and Union Street (NYS RT 211) and is designated on the Village tax maps as Section 202, Block 3, Lot 13 and is located in a B2 (Village Business) zoning district.

A copy of the application and all related documentation are on file in the Village Clerk's Office for review during regular business hours.

At the above date, time and place all interested persons will be given a reasonable opportunity to be heard. Written comments will be received by the Board no later than September 27, 2021.
